Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Water Gurus Kenya platform ("Water Gurus", "we", "us"). By creating an account or using the platform, you agree to these Terms. If you do not agree, please do not use the platform.

1. Who We Are

Water Gurus is a marketplace that connects customers seeking water services (such as borehole drilling, tank cleaning, water delivery, pump repair, and water treatment) with independent, verified service providers across Kenya. Water Gurus is not itself a water service provider.

2. Accounts and Eligibility

• You must provide accurate, current information when registering and keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.

3. Service Providers

• Providers must submit accurate business information and, where required, valid certifications for verification before receiving job requests.
• Providers are independent contractors, not employees or agents of Water Gurus. Water Gurus does not control the manner in which providers perform services.
• Providers are responsible for the quality, safety, and legality of the services they perform.
• Water Gurus may suspend or remove a provider's verification status for policy violations, fraud, or repeated customer complaints.

4. Customers

• Customers are responsible for providing accurate service request details, including location and scope of work.
• Customers agree to review quotations carefully before accepting and to communicate promptly with the assigned provider.

5. Quotations, Jobs, and Payments

• Providers set their own pricing. Quotations are offers, not guarantees of availability until accepted.
• Payments for accepted jobs are held in escrow and released to the provider once the customer confirms the job is complete, or as otherwise described in the platform's payment flow.
• Payouts to providers are processed after successful job completion and any applicable review period.
• Water Gurus may charge a service fee or commission on completed jobs, as communicated on the platform.

6. Disputes

If a disagreement arises between a customer and provider regarding a job, either party may raise a dispute through the platform. Water Gurus will review the available information and may facilitate a resolution, including adjusting an escrow release, at its reasonable discretion.

7. Prohibited Conduct

• Providing false, misleading, or fraudulent information.
• Circumventing the platform to avoid fees (e.g. arranging payment outside escrow for a job originated on the platform).
• Harassing, threatening, or discriminating against other users.
• Using the platform for any unlawful purpose.

8. Reviews and Ratings

Customers may rate and review completed jobs. Reviews must reflect genuine experiences and may not contain abusive, defamatory, or unlawful content. Water Gurus may remove reviews that violate this policy.

9. Limitation of Liability

Water Gurus provides a platform to facilitate connections between customers and providers and does not guarantee the quality, safety, or outcome of any service performed. To the maximum extent permitted by law, Water Gurus is not liable for damages arising from services performed by providers, disputes between users, or platform downtime.

10. Termination

We may suspend or terminate your account for violation of these Terms, fraudulent activity, or as required by law. You may close your account at any time by contacting support.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Kenya.
